Following this, on 21 June 2024, the Local Court of Bielefeld ordered provisional insolvency proceedings and appointed Dr André Wehner from PLUTA Rechtsanwalts GmbH as provisional administrator. He is now looking for an investor that will make the furniture component supplier fit for the future.

Amscan Europe GmbH has filed for insolvency. Yesterday, the Local Court of Esslingen then ordered provisional insolvency administration for the company’s assets and appointed Mr Steffen Beck from PLUTA Rechtsanwalts GmbH as provisional administrator.

Having maintained its operations within the framework of debtor-in-possession proceedings for the past 14 months, shoe wholesaler J.H. Pölking has achieved a restructuring plan solution. Creditors approved the submitted insolvency plan in early May 2024. The Local Court of Osnabrück has terminated the restructuring proceedings effective 31 May 2024.

Weissglut GmbH, which runs the restaurant of the same name in Amberg, Bavaria, has filed for insolvency. Following this, on 5 June 2024, the Local Court of Amberg ordered provisional insolvency proceedings and appointed Mr Daniel Barth from PLUTA Rechtsanwalts GmbH as provisional administrator.

Fintech company Dock Financial based in Munich has filed for insolvency. On 22 May 2024, the Local Court of Munich ordered provisional insolvency proceedings. The court appointed attorney Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for Dock Financial GmbH. His colleague, attorney Ms Marlene Scheinert, was appointed provisional insolvency administrator for parent company Dock Financial Capital GmbH. Both restructuring experts are being supported by attorney Mr Mirko Möllen.

Achtzig20 GmbH has initiated debtor-in-possession restructuring proceedings with the aim of putting the management consultancy firm on a viable footing. Dr Maximilian Pluta and Mr Hans-Christian Källner, restructuring experts at PLUTA Rechtsanwalts GmbH, are supporting the repositioning under the lead management of Mr Ivo-Meinert Willrodt. In early June, the Local Court of Ingolstadt ordered provisional debtor-in-possession management and appointed attorney Mr Marc-André Kuhne from law firm dkr kuhne dr. raith in Munich as provisional insolvency monitor. He is overseeing the proceedings and representing the interests of the creditors.

The PLUTA team has been able to achieve a follow-up solution under debtor-in-possession proceedings for Falter, a company based in the federal state of Hesse. Die Dachspezialisten GmbH, a Lighthouse Group company, has acquired the business operations and all remaining employees by way of an asset deal, effective 1 June 2024.

The PLUTA team has announced the sale of another company as part of the Allgaier Group’s insolvency proceedings. Insolvency administrator Mr Fritz Zanker has sold the Mexican subsidiary of Allgaier Werke GmbH to an Italian investor. Some 500 jobs in Mexico will therefore be saved.

Mr Ilkin Bananyarli from PLUTA Rechtsanwalts GmbH has achieved a follow-up solution for Koelble & Brunotte GmbH, the operator of the eponymous, long-established fashion store in Stuttgart city centre. Following intensive negotiations, the insolvency administrator has succeeded in finding an investor for the business. The buyer will acquire the operations as part of an asset deal, effective 1 June 2024, and keep on all 14 employees. The purchase agreement has already been signed.

Real estate developer INTERBODEN has been sold. Management, advisors at law firm ATN, attorney Dr Marc d’Avoine, Mr Ignacio Ordejón and attorney and business management expert Mr Paul Michels as well as attorney Dr Uwe Paul from PLUTA Rechtsanwalts GmbH have found an investor. The Götzen shareholder family provided significant support for the process.

Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH has been appointed insolvency administrator for MARO Genossenschaft für selbstbestimmtes und nachbarschaftliches Wohnen eG, a cooperative with a mission to enable people to lead self-determined lives within community settings. The Local Court of Munich ordered regular insolvency proceedings for the cooperative on 28 May 2024.

DIY Element System GmbH based in Rottenacker has filed for debtor-in-possession insolvency with the Local Court of Ulm. Restructuring expert Mr Marc-Philippe Hornung from law firm SZA Schilling, Zutt & Anschütz joined the management board once the provisional debtor-in-possession proceedings were ordered and is supporting DIY in these. The Local Court of Ulm (insolvency court) has appointed Mr Georg Jakob Stemshorn from PLUTA Rechtsanwalts GmbH as provisional insolvency monitor.

Insolvency administrator Mr Ilkin Bananyarli from PLUTA Rechtsanwalts GmbH has found a sustainable solution in the proceedings for campus GmbH Bauten für Bildung und Sport. An insolvency plan requiring creditor approval was drawn up in recent weeks. This has secured the future of the firm of architects, which is primarily involved in the design and construction of public facilities.

Some of the companies in the wohninvest real estate group based in Fellbach, near Stuttgart, have filed for insolvency. The Local Court of Stuttgart, as the competent court, has appointed attorney Mr Ilkin Bananyarli from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator.

In the insolvency proceedings for automotive supplier FRIMO, insolvency administrator Mr Stefan Meyer from PLUTA Rechtsanwalts GmbH, a specialist attorney for insolvency and restructuring law, has announced the completion of the M&A transaction. Through his efforts and those of his PLUTA restructuring team, management at the company and advisors to the buyer, FRIMO Innovative Technologies GmbH, all closing conditions contained in the company purchase agreement have been met and the transaction has therefore been completed. This brings to a successful conclusion the process of finding an investor for the automotive supplier, which currently employs around 900 people worldwide.

AMIA Energy GmbH filed for insolvency on 8 May 2024. Following this, on the same day, the Local Court of Charlottenburg ordered provisional insolvency administration for the company’s assets and appointed attorney Mr Sebastian Laboga from PLUTA Rechtsanwalts GmbH as provisional administrator.

Good news in the insolvency proceedings for personnel service provider Hartmann Personaldienste GmbH based in Düsseldorf: Tempton Personaldienstleistungen GmbH will manage the business going forward. Almost all jobs have been saved.

Insolvency administrator Mr Peter Roeger from PLUTA Rechtsanwalts GmbH has announced that the insolvency plan is now legally binding and the Bayreuth Tigers have therefore been saved. No creditor objected to the insolvency plan for the restructuring of Bayreuth Tigers Eishockey GmbH (now onesto Tigers Bayreuth Eishockey GmbH) in the past 14 days. The Local Court of Bayreuth will terminate the insolvency proceedings in the coming weeks and Bayreuth will continue to enjoy professional ice hockey as the club is now in a position to apply for its Upper League licence.

Insolvency administrator Mr Daniel Barth from PLUTA Rechtsanwalts GmbH has found an investor for sole proprietorship feiermeier. Effective 7 May 2024, the newly founded company May Party GmbH will acquire the feiermeier stores on Sigmundstrasse in Nuremberg, in Trudering and Moosach in Munich, and in Würzburg. This will also secure 34 jobs. The parties have agreed not to disclose the purchase price.

Having kept the business operating for four months, insolvency administrator Mr Patrick Meyerle from PLUTA Rechtsanwalts GmbH has concluded the process of finding an investor for TRAMAG Transformatorenfabrik GmbH & Co. KG with an asset deal.

Restructuring expert Mr Michael Bohnhoff is conducting a process aimed at finding an investor for mittemitte GmbH. After the company had to file for insolvency in mid-March, the Local Court of Charlottenburg appointed Mr Michael Bohnhoff from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator.

The rescue of Bayreuth Tigers Eishockey GmbH is within reach. Today, the creditors’ assembly approved the insolvency plan by a large majority in the proceedings. Restructuring expert Mr Peter Roeger from PLUTA Rechtsanwalts GmbH had drawn up the plan beforehand and submitted it to the Local Court of Bayreuth using his right of submission under the German Insolvency Code (InsO). The insolvency plan presented puts the creditors in a better position compared to the liquidation of the ice hockey club. Any appeal must now be lodged within 14 days.

Boryszew Oberflächentechnik Deutschland GmbH based in Prenzlau is to reposition itself under debtor-in-possession restructuring proceedings. Sister company Boryszew Formenbau Deutschland GmbH located in Doberschau has also filed for the same. The Local Court of Neuruppin assented to both applications today and ordered provisional debtor-in-possession proceedings. Mr Ingo Thurm and Dr Oliver Liersch from PLUTA Rechtsanwalts GmbH will manage the repositioning process as chief restructuring officers (CROs).

Töpfer GmbH from Dietmannsried, near Kempten, has filed an application for restructuring under debtor-in-possession proceedings. Today, the Local Court of Kempten then ordered provisional proceedings.

Mr Andreas Vogel, the well-known Cuxhaven restaurateur running seafood restaurant Hus op’n Diek, has filed for insolvency. On 4 April 2024, the Local Court of Cuxhaven ordered provisional insolvency administration for his assets and appointed Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH as provisional administrator.

The Stute Group based in Paderborn has filed for insolvency for three of its key operating companies to restructure itself as a debtor in possession. The producer businesses concerned, namely Stute Nahrungsmittelwerke, Paderborner Kühlhaus and K-S-K Technische Betriebswerkstätten, have lost considerable sales volumes in recent years due to customers obtaining the relevant products from Eastern Europe. According to the most recently published annual accounts, the Stute holding company achieved sales of approx. 234 million euros in 2021.

Aachen-based network solutions specialist devolo has safeguarded its future by successfully concluding the process of finding an investor. With retroactive effect from 1 April 2024, Austrian financial investor SOL Capital has acquired significant parts of the operating business by way of an asset deal. devolo, a renowned industry leader, is widely known and well respected on account of its numerous innovations in the IT market. The purchase agreement was signed on 17 April 2024 and executed immediately thereafter.

Mr Steffen Beck from PLUTA Rechtsanwalts GmbH has announced the conclusion of the process of finding an investor for interior decorator TTL OP. As insolvency administrator for TTL OP GmbH, he has achieved a follow-up solution for four branches in Dillingen, Heilbronn, Schwäbisch Gmünd and Aalen. A newly established transfer company will take over the locations and some 40 employees.

Insolvency administrator Mr Philip Konen from PLUTA Rechtsanwalts GmbH has found an initial partial solution for the insolvent Traumhaus AG (ISIN: DE000A2NB7S2). With economic effect from 1 April 2024, SAENTIS Family Office GmbH has acquired a major part of the real estate developer’s assets. The persons responsible signed the corresponding purchase agreement today.

PLUTA restructuring expert Mr Michael Wahl has succeeded in achieving an investor solution for software company remoso. Effective 1 April 2024, ACA GmbH based in Krauchenwies and Reutlingen has acquired remoso’s assets and all 30 employees at its sites in Ravensburg and Ettlingen by way of an asset deal.
