In this chapter we will examine this in relation to a specific case, the Niki Luftfahrt GmbH insolvency proceedings. What makes this case notable is that the German preliminary administrator tried to change the centre of main interest (COMI) by only argumentation and interpretations of facts, so without relocation of the registered office or the transfer of assets.
