PLUTA attorney Dr Kaufmann appointed provisional administrator for care service provider Up Visite

Ambulanter Pflegedienst Up Visite GmbH, an outpatient care service provider, filed for insolvency on 16 February 2024. The Local Court of Aurich, as the competent court, then appointed attorney Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator. The care service provider based in Krummhörn remains fully operational.

“At the outset, I would like to emphasise that all patients will continue to receive the same level of care,” stated PLUTA restructuring expert Dr Kaufmann. “
Together with my team and management, I am in the process of gaining a comprehensive overview of the company’s financial situation. We aim to work out a sustainable solution for Up Visite,” added the specialist attorney. In addition to Dr Kaufmann, the team also includes attorney Ms Christine Behrens and business lawyer Ms Nicole Neumerkel.

The salaries of the some 30 employees are guaranteed for a period of three months thanks to the so-called insolvency substitute benefits provided through the Federal Employment Agency. Staff have already been informed about the current situation. The care service provider has encountered liquidity problems due to a number of factors, including sharp cost increases. “The situation is not easy. We have filed for insolvency at an early stage so that we can respond to the challenges and equip ourselves for the future. I will support the provisional insolvency administrator to the best of my abilities,” said managing director Ms Ulrike Newiger.

Up Visite offers people in need of assistance the best possible care at home. The outpatient care provider based in Greetsiel in the municipality of Krummhörn provides various services, including basic, treatment and holiday care. In addition, Up Visite runs two residential communities for a maximum of 20 people and regularly cares for another 60 or so people on an outpatient basis.

Dr Christian Kaufmann has extensive experience in restructuring and turning around companies in debtor-in-possession and ordinary insolvency proceedings. Among other things, he is currently also provisional insolvency administrator for two companies within the Diakonie charitable organisation in the Oldenburg Land region in charge of two elderly care establishments.
