PLUTA team achieves follow-up solution for roofing company Falter

The PLUTA team has been able to achieve a follow-up solution under debtor-in-possession proceedings for Falter, a company based in the federal state of Hesse. Die Dachspezialisten GmbH, a Lighthouse Group company, has acquired the business operations and all remaining employees by way of an asset deal, effective 1 June 2024.

The company has been involved in debtor-in-possession proceedings ordered by the Local Court of Darmstadt since mid-March 2024. Attorney Ms Sylvia Rhein from law firm Rhein Rechtsanwälte PartGmbB was appointed provisional insolvency monitor by the insolvency court. Attorneys Mr Philip Konen and Ms Kristina Breuer from PLUTA Rechtsanwalts GmbH have assisted the company during the proceedings as general agents. Mr Nikolaus Röver, Head of M&A Transactions at PLUTA Management GmbH, has supported the M&A process.

Mr Philip Konen stated, “We are pleased that we could already transfer the business with the opening of the proceedings, which will ensure continued operations and secure all of the jobs.”

Falter GmbH based in Trebur has been specialising in roofing work in the Rhine-Main region for over 20 years. In addition to standard work on pitched, flat and slate roofs on new and existing properties, it also provides professional roof repair and roof extension services.

The roofing business has remained fully operational while the proceedings were ongoing. The buyer will take on all customer orders and complete them in consultation with the respective clients.

Debtor-in-possession proceedings are in-court restructuring proceedings to rescue and rehabilitate financially distressed companies. Management remains in charge and guides the company through the proceedings itself, supervised by an insolvency monitor and supported by restructuring experts.
