Initial solution for Mäschle bakery stores

Mr Florian Schiller from PLUTA Rechtsanwalts GmbH has found an initial follow-up solution for three Mäschle bakery stores. The purchase agreement was signed yesterday. Ulm-based bakery operation Staib will acquire one store in Erbach and a further two in the Kaufland hypermarkets in Laupheim and Langenau. Employees will receive job offers from Staib, a family-run business. Bäckerei Staib GmbH & Co. KG has been supported in the transaction by attorney Mr Armin Schneider from Biberach.

Bäckerei Mäschle OHG, based in Laupheim, has been engaged in restructuring proceedings as a debtor in possession since January 2024. The business continued operating in 13 stores until the end of September. The debtor-in-possession proceedings were terminated and converted to regular proceedings by the Local Court of Ravensburg on 13 September. Attorney Mr Florian Schiller was appointed insolvency administrator at the same time, having supervised the proceedings in the interests of creditors as insolvency monitor prior to that. He is being supported in the proceedings by business lawyer Mr Franco W. Caputo.

Attorney Mr Michael Winterhoff from WINTERHOFF Rechtsanwalts GmbH in Ulm has been acting as legal adviser over the past nine months. Ultimately, an agreement with creditors within the framework of an insolvency plan solution could not be implemented as Bäckerei Mäschle OHG’s recent earnings position was below projections and it was making losses.

Mr Florian Schiller from PLUTA said, “Staib has made an offer for three stores. We have found an initial partial solution with the signed agreement, but nothing is yet in place for the other Mäschle stores.” The insolvency administrator is in negotiations with the Mäschle brothers, who want to continue running several stores. Such a purchase agreement can only be signed once the specific implementation and necessary financing have been organised.

Further expansion of a long-standing bakery

Staib is a long-standing bakery with more than 40 stores in Ulm, Neu-Ulm, Senden and other locations in the region, including Laupheim. Its roots go back 90 years and it is known for its premium quality. Founded in Ulm in 1934, the family-run business has been committed to traditional baking methods for three generations.
